Terms of Service (ToS) / User Agreement

Welcome to EchoNest. These Terms of Service (“Terms”) govern your use of our website, mobile app, and AI therapy services (“Services”). By using EchoNest, you agree to these Terms. If you do not agree, do not use our Services.

1. Eligibility

• You must be at least 16 years old to use EchoNest.
• By using EchoNest, you confirm you have the legal capacity to agree to these Terms.

2. Nature of Service

• EchoNest provides AI-powered mental wellness support through chat, voice, journaling, and mood tracking.
• EchoNest is not a licensed therapist, psychiatrist, psychologist, or medical provider.
• Our Services are for wellness, reflection, and support only and are not a substitute for professional medical or mental health care.

3. Crisis Situations

If you are experiencing a crisis, suicidal thoughts, or any emergency, do not use EchoNest. Call your local emergency number immediately.

4. Accounts & Access

• You are responsible for maintaining the confidentiality of your login credentials.
• You must not share your account or misuse EchoNest.
• We may suspend or terminate accounts that violate these Terms.

5. Payments & Subscriptions

• We offer a free trial (1 hour of voice therapy).
• After the trial, you can choose a subscription plan (Chat Only, Voice Only, or Voice + Chat).
• Payments are processed securely via third-party providers (e.g., Stripe).
• All prices are displayed in USD (or local equivalent).

6. Refunds & Cancellations

• Refunds and cancellations are governed by our Refund & Cancellation Policy (see below).
• You may cancel at any time, but partial refunds are not provided except as required by law.

7. Acceptable Use

You agree not to:

• Use EchoNest for unlawful or harmful activities.
• Upload or share offensive, abusive, or misleading content.
• Attempt to hack, reverse-engineer, or misuse our Services.

8. Data & Privacy

• Your use of EchoNest is also governed by our Privacy Policy.
• We take security seriously and protect your data using encryption and secure storage.

9. Limitation of Liability

• EchoNest provides support but does not guarantee specific mental health outcomes.
• We are not liable for decisions you make based on EchoNest conversations.
• To the maximum extent permitted by law, EchoNest disclaims liability for indirect, incidental, or consequential damages.

10. Changes to Terms

We may update these Terms from time to time. Continued use of EchoNest after updates constitutes acceptance of new Terms.
